A resident brought a concern to the HOA Board regarding a sunken and cracked curb section adjacent to 737 Cedar Hill Drive. After investigation, the HOA Board confirmed that this area โ the curb along Cedar Hill Drive โ falls under the maintenance responsibility of the City of Shelby, not the HOA or the individual homeowner.
๐ฌ Update โ April 30, 2026: The City of Shelby has confirmed that the curb at 737 Cedar Hill Drive has been placed on the City's repair list. While the damage is considered mostly cosmetic at this time, the City anticipates completing the repair within approximately two months, once current ADA ramp and sidewalk work throughout the city is complete.
Background
In April 2026, a resident contacted the HOA inquiring whether the curb section near 737 Cedar Hill Drive could be repaired as part of the HOA's ongoing sidewalk repair work. The HOA Board investigated the situation and determined the following:
- The HOA's recent sidewalk repairs were specifically for a damaged culvert under HOA ownership โ not general sidewalk or curb maintenance.
- Sidewalk upkeep on individual properties is the homeowner's responsibility.
- The curb section along Cedar Hill Drive is part of the city street infrastructure and is therefore a City of Shelby responsibility.
HOA President Nathan David contacted the City of Shelby's Street Division on behalf of the community to request a status on the repair.
City of Shelby Response
On April 30, 2026, Scott Black of the City of Shelby responded with the following assessment:
"We have taken a look at this situation, and it has been put on our repair list. Although the area has sunk a little and cracked, it is mostly cosmetic and will not be a priority at the moment. We are working on ADA ramps and sidewalk repairs throughout the city preparing for street resurfacing and we still have several weeks of this work left. I anticipate upwards of two months before we can complete your repair."

๐ก Good news for residents: No action is required. The City of Shelby has acknowledged the issue and it is on their repair schedule. The HOA Board will continue to monitor and follow up with the City as needed.
