The Short Answer

Sidewalk responsibility in Pebble Creek is divided between individual homeowners and the City of Shelby, depending on what's involved:

  • Construct the sidewalk on your lot (if not already built)
  • Repair any broken sidewalk sections โ€” immediately
  • Keep the sidewalk clear and in good condition

  • Owns and maintains streets, sidewalks, curbs
  • Owns and maintains light poles
  • Maintains waterlines (to the meter) and sewer lines (to property line)

Note on the split: The covenants place both obligations in effect simultaneously. The City owns the public infrastructure, but the HOA Restrictions independently require each homeowner to construct and promptly repair the sidewalk fronting their lot. If your sidewalk is broken, don't wait โ€” repair it.

What the Restrictions Say

Section 6.3(l) โ€” Homeowner sidewalk obligation:

"Sidewalks (4 feet in width by the entire frontage, including corners) shall be constructed on each and every lot and will conform to specifications as established by the City of Shelby. If the sidewalk is broken after construction, the sidewalk shall be repaired immediately by the homeowner." โ€” Section 6.3(l), Pebble Creek Declaration of Restrictive Covenants

Section 6.3(m) โ€” City of Shelby infrastructure:

"Streets, sidewalks, light poles, waterlines up to and including the meter, sewer lines up to the property line and curbs are the property of the City of Shelby and are maintained by such." โ€” Section 6.3(m), Pebble Creek Declaration of Restrictive Covenants

Sidewalk Construction Requirements

If a sidewalk has not yet been constructed on your lot, the specifications are:

  • Width: 4 feet
  • Length: Entire lot frontage, including corners
  • Standards: Must conform to City of Shelby specifications

โš ๏ธ Vacant lot buyers: If you purchased a vacant lot from the Developer without a sidewalk, 150% of the estimated construction cost was required to be held in escrow at closing. Those funds are available to you for up to one year. If not used within one year, the Developer may use the funds to construct the sidewalk, retaining any surplus as an administrative cost.
